The Endorsement of Minority Rights: The Role of Group Position, National Context, and Ideological Beliefs

The present research was conducted in the Netherlands and used an experimental design to examine the endorsement of minority rights among Turkish and Kurdish participants in two framed, national contexts: the Netherlands and Turkey. In the Dutch context, each group is a minority, whereas in the Turkish context the Kurds are an oppressed national minority and the Turks are the national majority. The results showed that the Turks were less in favor of minority rights in the Turkish context than in the Dutch context, whereas the Kurds were more in favor of minority rights in the Turkish than in the Dutch context. In addition, the endorsement of minority rights was related to beliefs about majority rule, state unity, and ingroup identification, as well as to cultural diversity and perceived pervasive discrimination. The associations with the former three measures differed between the two groups and the two national contexts, whereas the latter two measures had main effects on the endorsement of minority rights. Muslim and Non-Muslim Adolescents' Reasoning About Freedom of Speech and Minority Rights

An experimental questionnaire study, conducted in the Netherlands, examined adolescents' reasoning about freedom of speech and minority rights. Muslim minority and non-Muslim majority adolescents (12,18 years) made judgments of different types of behaviors and different contexts. The group membership of participants had a clear effect. Muslim participants were less in favor of freedom of speech if it involved the offending of religious beliefs and were more in favor of Muslim minority rights. There were also cross-group gender differences whereby parental practices that negatively affect females were more strongly rejected by Muslim females than by Muslim males and non-Muslim females and males. The findings are discussed with reference to social-cognitive domain theory and intergroup theories. [source]


Differentiating the democratic performance of the West

It is a commonplace of comparative politics that the democratic performance of the established democracies of the West is both uniform and superior to that of other democracies across the globe. This commonplace both reflects and reinforces the mainstream measures of democracy, like those of Freedom House or Polity III, that fail to differentiate the democratic performance of the West. This article examines this commonplace by deploying the measures of democratic performance contained in the newly constructed Database of Liberal Democratic Performance, and uses descriptive statistics (means and variance) to compare the performance of individual Western democracies, as well as the West overall with the ,rest'. The Database is designed to capture a wider normative range of performance than the mainstream measures, and shows that the performance of the West is neither uniform nor superior in every respect, especially with regard to civil and minority rights. These findings are explored and confirmed by comparative case studies of minorities in the criminal justice systems of those Western democracies that tend to perform worst in this respect. In conclusion, it is suggested that the findings may begin to change the way we view the relationships between economic growth and democracy, political culture and democracy, and even constitutional design and democracy. Averting Forced Migration in Countries in Transition

Many countries of emigration are in transition from conflict to peace and from authoritarian to democratic governments. Addressing population movements from these countries requires more than economic opportunities; equally important is the establishment of the rule of law, respect for human rights, and, in countries recovering from conflict, reconstruction of destroyed infrastructure and housing. Otherwise, fragile peace and democratization processes can easily break down, creating new waves of forced migrants and hampering efforts towards repatriation and reintegration of already displaced populations. This background paper discusses the nature of forced migration, pointing out that the end of the Cold War has produced new pressures and new opportunities to address these flows. While extremism, particularly rampant nationalism, has provoked massive forced migration in many parts of the world, the changing geopolitical relations has also led to peace settlements in some countries and humanitarian intervention to reduce suffering in others. Addressing forced migration pressures in countries in transition requires comprehensive policy approaches. Four types of best practices are considered in this paper. First, mechanisms to ameliorate the causes of forced movements, including the role that expatriate communities can play in strengthening the rule of law and respect for human rights, particularly minority rights. Second, mechanisms that enhance refugee protection while minimizing abuses of asylum systems, including enhanced respect for the refugee convention, adoption of complementary forms of protection when the refugee convention does not apply, strengthened regional protection, and the establishment of in,country processing of refugee claims. Third, mechanisms to resolve the longer,term status of forced migrants, including decisions on when to cease refugee status and temporary protection and encourage/permit return or integration. Fourth, mechanisms for more effective repatriation when return is possible, particularly programs to help returnees reintegrate and communities reconstruct themselves. [source]


Risking Security: Policies and Paradoxes of Cyberspace Security

Conceptualizations of cyberspace security can be divided into two related dimensions, articulated as "risks": risks to the physical realm of computer and communication technologies (risks to cyberspace); and risks that arise from cyberspace and are facilitated or generated by its technologies, but do not directly target the infrastructures per se (risks through cyberspace). There is robust international consensus, growing communities of practice, and an emerging normative regime around risks to cyberspace. This is less the case when it comes to risks through cyberspace. While states do collaborate around some policy areas, cooperation declines as the object of risk becomes politically contestable and where national interests vary widely. These include the nature of political opposition and the right to dissent or protest, minority rights and independence movements, religious belief, cultural values, or historical claims. The contrast between the domains has led to contradictory tendencies and paradoxical outcomes. [source]


A Bargaining Theory of Minority Demands: Explaining the Dog that Did not Bite in 1990s Yugoslavia

This article develops a general theory of bargaining between a minority, its host state, and outside lobby actor to explain why minorities shift their demands from affirmative action to cultural autonomy to secessionism and back, often in the absence of clear economic or security incentives. This paper uses a simple game tree model to show that if a minority believes that it enjoys significant support from a powerful national homeland or other external actor, it radicalized its demands against the host state, even if the center has credibly committed to protect minority rights. Conversely, if a minority believes that it enjoys no external support, then it will accommodate the host state, even in the presence of significant majority repression. As a general theory of claim-making, this model challenges structural theories of demands that rely on static economic differences or historical grievances to explain claim-making. It also challenges security dilemma arguments that hold that minority radicalization is mainly a function of ethnic fears. The model's hypotheses are tested using longitudinal analysis of Hungarians in Vojvodina during the 1990s, as the Yugoslav dog that "barked but did not bite." Careful examination of claim-making in this case demonstrates the superior explanatory power of the ethnic bargaining model as compared with dominant theories of minority mobilization in the literature. The Uneven Performance of Third Wave Democracies: Electoral Politics and the Imperfect Rule of Law in Latin America

ABSTRACT This article investigates the performance of the new democracies of the third wave by developing a conceptual model of the core elements of liberal democratic government and by constructing a new Database of Liberal Democratic Performance. The performance is shown to be uneven in two main ways. First, the institutional attributes of democratic government advance while individual and minority rights languish. Second, particular institutional attributes coexist uncomfortably, as do particular rights. A comparison of Brazil, Colombia, and Guatemala complements the big picture drawn from the database and focuses on the specific contextual conditions that can create the general political contours of the wave. The uneven democratic performance of these cases is mainly explained by the combination of persistent oligarchic power and a largely unaccountable military. Yet uneven performance, and the imperfect rule of law in particular, does not necessarily prevent democratic survival. [source]


The model of ethnic democracy: Israel as a Jewish and democratic state

The liberal democratic nation,state is on the decline in the West as a result of globalisation, regionalisation, universalisation of minority rights, multiculturalism and the rise of ethno,nationalism. While Western countries are decoupling the nation,state and shifting toward multicultural civic democracy, other countries are consolidating an alternative non,civic form of a democratic state that is identified with and subservient to a single ethnic nation. This model, ,ethnic democracy', is presented; its defining features, the circumstances leading to it and the conditions for its stability are elaborated upon; and it is applied to Israel. Contrary to its self,image and international reputation as a Western liberal democracy, Israel is an ethnic democracy in which the Jews appropriate the state and make it a tool for advancing their national security, demography, public space, culture and interests. At the same time, Israel is a democracy that extends various kinds of rights to 1 million Palestinian Arab citizens (16 per cent of the population) who are perceived as a threat. The criticisms against the general model and its applicability to Israel are discussed. The model has already been applied to other countries, but more applications are needed in order to develop it further. [source]

The Politics of Court Budgeting in the States: Is Judicial Independence Threatened by the Budgetary Process?

Judicial independence in American politics has been hailed as a means of preserving individual liberty and minority rights against the actions of the majoritarian branches of government. Recently, however, legal professionals and scholars of the courts have begun to question the magnitude of judicial independence, suggesting that budgeting and finance issues pose a threat to judicial independence. This article explores whether state judiciaries are being threatened on this front by soliciting the perceptions of key state officials. Using surveys of court administrators, executive budget officers, and legislative budget officers in the states, we examine three aspects of the politics of judicial budgeting: competing for scarce resources, interbranch competition, and pressure to raise revenues. The survey responses suggest that, in a substantial number of states, judicial independence has, at times, been threatened by interbranch competition and pressures to raise revenues. [source]
